By accessing and using this Website, the services offered on this website and by using the Inertia platform, you have opted in to the Inertia offerings and agree to be bound by the terms and conditions set out herein. If you do no wish to be bound by these terms and conditions, you may not utilize the Inertia platform, and you must cease your access and use of the website immediately.

Inertia may amend these terms and conditions from time to time without notice to you, and it is your duty to familiarise yourself with the current version of these terms and conditions when accessing the Website. Continued use of the Website constitutes your acceptance of the terms and conditions as amended. The date of last revision will appear at the end of these terms and conditions.

Definitions and interpretation:

  1. “Content” including but not limited to: text, submissions, images, audio and/or video, and PDFs in whole or in part;
  2. “Submissions” – including but not limited to notes, images, creative materials, ideas, suggestions concepts, and communication including any data, questions, comments and other information submitted to the Website via transmission by electronic mail or otherwise;
  3. “The Provider” or “Inertia” means INERTIA VENTURES (PTY) LTD (Registration Number 2025/103678/07). 
  4. “User” means any person who enters, uses or accesses the Website, notwithstanding the fact that such a person only visited the home page of the website;
  5. “The Website” means the Inertia website located at www.inertiaplanning.com and includes any part or element thereof;
  6. “Consumer” has the meaning given to it as defined in the Electronic Communications and Transactions Act 25 of 2002 as well as the Consumer Protection Act, 68 of 2008 (the “CPA”)​;

In this agreement unless it appears to the contrary, the singular shall include the plural and vice versa, any reference to any gender shall also includes the opposite gender and any reference to a natural person, shall include legal person and vice versa.

  1. Website subscription:
  1. As a user of this the Website you are granted a nonexclusive, nontransferable, revocable, limited subscription to access and use the Website and Content in accordance with these Terms of use. Inertia may terminate this subscription at any time for any reason.

  4. Inertia permits the use of the Website subject to the Terms and Conditions. By using this Website in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally. You must not use this Website if you do not agree to the Terms and Conditions.

  1. Our Services
  1. Inertia provides a platform for financial advisors. It is a self-help and guided platform that helps the financial advisor demonstrate a financial plan to their clients.
  2. The platform offers a graphic demonstration of an individual’s financial plan based on specific submissions and responses received from the User and does not constitute any legal or financial advice.
  3. The tool makes use of, amongst other things, the following:
  1. Growth Fund” means money that is fully accessible at any time during retirement, including, the after-tax lump sum taken from retirement savings at retirement and all discretionary investments not tied to retirement rules.
  2. Replacement Ratio” means the percentage of required income that is covered by available retirement income sources. A replacement ratio below 100% indicates a shortfall during retirement, in other words, without adjusting your current spending, there will be insufficient income to meet your expenses at retirement.
  3. Scenario Planner” is a tool used to gain an understanding of the amount that needs to be contributed or growth earned in order to remove any deficit during retirement and to determine what is needed to eliminate any projected income shortfall during retirement, depending on the following scenarios:
  1. Lump sum/monthly contribution calculates the additional capital invested today or recurring contributions required to fund your retirement income needs fully.
  2. Required interest rate determines the investment growth rate that must be achieved on your existing capital and future contributions to fund your retirement income needs fully.

The Website and platform offer users an overview of their current financial situation and illustrates how the current investment strategy and financial decisions may affect the user’s retirement. Although the Website provides users with legal information that is generally applicable and permits users to utilise the services, the information is intended to be applicable to a broad group of people.

  1. Trademark, copyright and restrictions on use:

  2. The Website consists of content that is derived entirely or in part from content sourced by and provided to Inertia, and other sources. The said content is protected under applicable South African Copyright and Trademark Laws, International Trademarks and Copyright Laws and conventions.
  3. The user is strictly prohibited from creating works that are based on the content found on this site. The prohibition applies regardless of whether the content is sold, negotiated, or given away and/or further alienated in any manner whatsoever.

The user may not, with the inclusion of but not the limitation of, reproduce, duplicate, publish, modify, copy, download, upload in any manner, post, broadcast or transmit, reverse engineer or disenable, display, or distribute or in any way exploit any of the content. The user may download or print one copy of the content on any single computer for their personal, non-commercial use, provided that all proprietary notices and restrictions on the content are kept intact unless prior written consent was obtained from Inertia.
  5. Users may not decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense or create derivative works from, or use this Website or Content to train, fine-tune, or otherwise develop large language models or other machine learning systems.
  6. Users are required to register and receive confirmatory e-mail messages in order to gain access to certain content or services on the Website.
  7. Users may not use any network monitoring or discovery software to determine the site architecture or extract information.
  8. Users may not use any robot, spider, web crawlers, other automatic software or device, or manual process to monitor, search or copy Inertia’s Website or the Content without Inertia’s prior written permission.
  9. Users may not use this Website to transmit any false, misleading, fraudulent, or illegal communications.
  10. Users may quote small and reasonable amounts of content available from the Website only if such quote is placed in inverted commas and appropriately referenced.
  11. Users may not copy, modify, reproduce, republish, distribute, display, or transmit for commercial, non-profit, or public purposes all or any portion of this Website, except to the extent permitted above.
  12. No person may frame the Website, in any manner whatsoever, without the prior written consent of Inertia.
  13. Inertia shall not be liable, in any manner whatsoever, for any damage, loss or liability that resulted from the use of such Content by the user or any third party who obtained any content from the user.

  1. Intellectual property rights and domain name use:

All intellectual property on the Website, including but not limited to content, trademarks, domain names, patents, design elements, software, databases, text, graphics, icons and hyperlinks are the property of or licensed to Inertia and as such, are protected from infringement by domestic and international legislation and treaties. Subject to the rights granted to the User in clause 2, all other rights to intellectual property on the Website are expressly reserved.

INERTIA VENTURES (PTY) LTD” is a registered trademark and Users agree not to use the INERTIA VENTURES (PTY) LTD trademark or trademark as an element of a domain name or subdomain name, notwithstanding the fact that such domain name use or registration may be allowed in terms of trademark and/or constitutional law. Upon request to do so, a User shall immediately cease to use such domain name and transfer it to Inertia at the cost of the User.
  3. Access to or use of this website will not in any way result in an assignment or license of any intellectual property owned by Inertia or any other party.
  4. You may not transmit, transcribe, reproduce, store, distribute or commercially exploit the contents of any product or tool arising from the website without Inertia’s express prior written consent, save as expressly permitted.

  1. It is the responsibility of the User to acquire and maintain, at his/her own expense, the computer hardware, software, lines and account to access the Website.

  1. Inertia expressly reserves the right, in its sole and absolute discretion, to do any of the following, at any time without prior notice:

  2. change the content and/or services available from the Website;
  3. discontinue any aspect of the Website or service(s) available from the Website; and/or
  4. change the software and hardware required to access and use the Website.

  1. Privacy:
  1. Inertia shall take all reasonable steps to protect the personal information of Users and for the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Visit Privacy Policy.
  2. Inertia may electronically collect, store and use the following personal information of Users:
  1. name and surname;
  2. birth date;
  3. gender;
  4. address;
  5. contact numbers;
  6. non-personal browsing habits and click patterns;
  7. e-mail address;

  1. Inertia collects, stores and uses the above-mentioned information for the following purposes:
  1. providing the Product, support and services to the User;
  2. subject to the User’s consent, inform the User of facts relating to his/her access and use of the Website;
  3. subject to the User’s consent, inform the User about competitions and special offers from Inertia and/or its partners/affiliates; and
  4. to compile non-personal statistical information about browsing habits, click patterns and access to the Website.
  1. Inertia may collect, maintain, save, compile, share, disclose and sell any information collected from users, subject to the following provisions:
  1. Inertia shall not disclose personal information from Users unless the User consents thereto;

  3. The user may ask Inertia for a copy of personal information and correct, delete or restrict the processing of your personal information. The user has the right to object to the processing of personal information in certain circumstances, subject to the applicable law. These rights may be limited if they would reveal personal information about another person or would infringe Inertia’s rights or those of a third party, or if Inertia is required by law to retain information or has a compelling legitimate interest in doing so.

Inertia shall not be responsible for and assumes no liability for any infringement, mistakes, misstatements of law, defamation, slander, libel, omissions, falsehood, obscenity or profanity in the statements, opinions, representations or any other form of content contained in any third party content appearing on this website.

  1. Inertia shall take all reasonable steps to secure the content of the Website however, Inertia does not make any warranties or representations that the content shall be 100% safe and secure.
  2. Inertia is under no legal duty to encrypt any content or communications from and to the Website and is also under no legal duty to provide digital authentication of any page on the Website.
  3. Users may not deliver or attempt to deliver, whether on purpose or negligently, any damaging code, such as computer viruses, to the Website or the server and computer network that support the Website. Notwithstanding criminal prosecution, any person who delivers any damaging code to the Website, whether on purpose or negligently, shall, without any limitation, indemnify and hold Inertia harmless against any and all liability, damages and losses Inertia and its partners/affiliates may suffer as a result of such damaging code.
  4. Users may not develop, distribute or use any device to breach or overcome the security measures of the content and Inertia reserves the right to claim damages to any and all persons concerned with a security failure or breach.

  1. Inertia, its owners, employees, suppliers, network operators, partners, affiliates and agents shall not be liable for any damage, loss or liability of any nature incurred by whomever and resulting from:
  1. access to the Website;

  3. inability to access the Website;
  4. inability to access websites linked to the Website;
  5. content available on the Website;
  6. services available from the Website;
  7. download, install and use the content or product; and
  8. any other reason not directly related to Inertia’s gross negligence.
  1. Inertia shall not be liable for any loss, claim, liability or damage of any kind resulting from the use of the Website.
  2. The Website and content are supplied on an “as is” basis and have not been compiled to meet the User’s individual requirements. It is the responsibility of the User to satisfy him/herself, prior to entering into this agreement with Inertia, that the content, products and services available from and through the Website meet the User’s individual requirements and is compatible with the User’s computer hardware and/or software.
  3. Information, ideas and opinions expressed by Inertia through electronic mail or on the Website should not be regarded as professional advice or the official opinion of Inertia and Users are encouraged to consult professional advice before taking any course of action related to the information, ideas or opinions expressed on the Website.
  4. This Website is directed primarily at Users in the Republic of South Africa and therefore Inertia shall not, as far as allowed by South African law, be liable for defamation, libel, slander, privacy infringement, personality infringement or copyright infringement, in whatsoever format, outside the borders of the Republic of South Africa.
  5. Inertia sources content from various third parties and does not control the content provided by such third parties and Inertia only serves as an electronic distribution platform for such third-party content. Therefore, Inertia shall not be liable, in any manner whatsoever for defamation, privacy infringement, personality infringement or copyright infringement related to content on the Website not created by Inertia or its employees.
  6. Inertia does not make any warranties or representation that content, products and services available from the Website will in all cases be true, correct or free from any errors. Inertia shall take all reasonable steps to ensure the quality and accuracy of content available from the Website.
  7. Inertia does not make any warranties or representations that the Website will be available at all times. Users acknowledge that the Website may be unavailable due to updates or other causes beyond the reasonable control of Inertia, including, but not limited to virus infection, power failure or other “acts of God”.

Users are encouraged to report untrue, inaccurate, defamatory, illegal, infringing and/or harmful content available on the Website to Inertia and Inertia undertakes to correct and/or remove such content or any part thereof if the person reporting such content provided reasonable grounds to prove the alleged nature of the content.

  1. Subject to the provisions of the Regulation of Interception of Communications (RIC) Act 70 of 2002, the User agrees to Inertia’s right to intercept, block, filter, read, delete, disclose and use all communications sent or posted by the User to the Website or its staff and employees.
  2. The User agrees and acknowledges that the consent provided by the User in clause 12.1 satisfies the “writing” requirement.

Inertia reserves the right to investigate complaints, suspicions or reported violations of our Term of use and to take any action we deem appropriate including but not limited to reporting any suspected unlawful activity to the applicable authorities, regulators or third parties and disclosing and information necessary to appropriate such persons or entities.

  1. Refund and cancellation policy:
  1. Subscriptions and Billing
  1. Subscriptions are billed on a monthly or yearly basis in advance, depending on the chosen subscription.
  2. By subscribing, you authorise us to automatically charge the payment method provided at the start of each billing period.
  3. We reserve the right to change subscriptions pricing and/or features. Any changes will be communicated to you in advance, and you will have the opportunity to cancel before the new term takes effect.
  1. Cancellation
  1. You may cancel your subscription at any time via your account settings.
  2. Cancellations take effect at the end of the relevant billing period.
  3. Once cancelled, you will continue to have access to your subscription until the end of the paid billing period.
  1. Refunds
  1. We do not offer refunds for partially used subscription periods.
  2. Refunds may be granted in the following circumstances, at the sole discretion of Inertia:
  1. Duplicate payments or billing errors;
  2. Technical issues preventing you from accessing the service, where we were unable to resolve the problem; or
  3. Where required under South African consumer protection laws.

  1. Entire agreement and severability:
  1. These terms and conditions constitute the entire agreement between Inertia and the User and shall take precedence over any disclaimers and/or legal notices attached to any communications and/or postings received by Inertia from the User.
  2. In the event that any term or condition detailed herein is found unenforceable or invalid for any reason, such term(s) or condition(s) shall be severable from the remaining terms and conditions. The remaining terms and conditions shall remain enforceable and applicable.

  1. Applicable and governing law:
  1. The Website is hosted, controlled and operated by the Republic of South Africa and therefore the South African law enforced by the South African courts governs the use or inability to use the Website, its content, services and these terms and conditions.

  1. Termination of agreement:
  1. The use of or access to the Website constitutes the User’s acceptance of the terms and conditions hereof, which are binding on the user and take effect on a date when the user first makes use of or accesses the Website.
  2. If the User does not accept all the terms and conditions in full, the User must exit the site immediately.
  3. Inertia has the exclusive discretion to terminate the agreement at any time.
  4. After the User has exited the site as aforesaid the User must destroy all content, whether content, materials or software, obtained from the site and all copies thereof.
  5. In the event of the User failing to exit the site as aforesaid Inertia has the right to claim any indirect, direct, incidental, special or punitive damages caused to Inertia from the User’s unauthorised access and/or use of the Website. The user further indemnifies Inertia against any claims for damages of whatsoever nature caused to another party by the User’s unauthorised use and/or access of the Website.
